The Malawi Electoral Commission (MEC) is an independent constitutional body established under Section 75(1) of the Constitution of Malawi and further governed by the Malawi Electoral Commission Act (Cap. 2:03). The Act provides for the composition, functions, and operational framework of the Commission. MEC is mandated to manage, direct, and supervise the conduct of Presidential, Parliamentary, and Local Government elections in a transparent, impartial, and efficient manner. It is composed of a Chairperson—who must be a judge nominated by the Judicial Service Commission—and at least six Commissioners appointed by the President in consultation with political parties represented in the National Assembly. The Commission operates as a body corporate with legal capacity to acquire property, sue or be sued, and execute tasks necessary to fulfill its electoral mandate. It also has its own secretariat, headed by a Chief Elections Officer, responsible for the day-to-day management of operations. The Act empowers MEC to regulate electoral processes, provide voter education, accredit observers and educators, and ensure free and fair elections in Malawi
